Welcome to NestNinja. These Terms of Service ("Terms") govern the relationship between NestNinja Home Services LLC ("NestNinja," "we," "our," or "us") and any builder, developer, general contractor, trade contractor, or other business ("Client") that requests or receives services from NestNinja. By submitting a work order or purchase order, or otherwise engaging NestNinja's services, Client agrees to these Terms.
NestNinja provides new construction, model home, spec home, and post-trade closeout cleaning operations to builders, developers, and trade contractors across the Phoenix metro area. Services are performed directly by NestNinja personnel or through vetted, insured, and background-checked independent contractors engaged by NestNinja.
Services are scoped and priced according to the rate schedule agreed between NestNinja and Client, or as specified on an individual work order or purchase order. Client agrees that:
NestNinja reserves the right to decline work orders at its discretion.
NestNinja may perform services using its own personnel or independent contractors who have completed NestNinja's vetting process, including insurance verification and background screening. By engaging NestNinja, Client acknowledges that:
Scheduled arrival windows are estimates and may be affected by:
NestNinja will make reasonable efforts to meet scheduled windows and will communicate delays as soon as they are known.
Client agrees to:
NestNinja is not responsible for delays or issues resulting from inaccurate site information or undisclosed hazards.
Invoices are issued upon completion of each job unless otherwise agreed in writing. Payment is due according to the terms specified on the invoice. Payments may be processed through secure third-party invoicing platforms. Late payment may result in suspension of future work orders and/or collection action.
Where required by Client or applicable to the project, NestNinja will provide conditional and/or unconditional lien waivers in accordance with standard construction industry practice and applicable Arizona law, upon receipt of payment.
Work orders may be canceled or rescheduled by Client. However:
NestNinja reserves the right to reschedule due to weather, safety concerns, or operational necessity, and will provide notice as early as possible.
Claims related to damage must be reported to NestNinja within 48 hours of job completion. NestNinja will review the claim and, where appropriate, coordinate correction with the responsible personnel. NestNinja is not responsible for:
To the fullest extent permitted by law, NestNinja shall not be liable for:
NestNinja's total liability arising out of or related to any work order shall not exceed the total amount paid by Client for that specific work order.
NestNinja maintains general liability insurance and requires its contractors to maintain appropriate coverage. Certificates of insurance are available to Clients upon request.
You agree not to:
NestNinja reserves the right to restrict or terminate website access if misuse occurs.
All website content, branding, graphics, and trademarks related to NestNinja are the property of NestNinja and may not be copied or used without permission.
Your use of the website is also governed by our Privacy Policy.
NestNinja may update these Terms at any time. Updated versions will be posted on the website with a revised effective date. Continued engagement of NestNinja's services constitutes acceptance of the updated Terms.
These Terms shall be governed by the laws of the State of Arizona. Any disputes arising from these Terms shall be resolved in the courts located within Arizona.
NestNinja invests in vetting, background-checking, and training the personnel who perform work for its Clients. By engaging NestNinja's services, Client agrees not to directly hire, solicit, or engage any NestNinja contractor or personnel introduced through a NestNinja work order, outside of NestNinja, for a period of 12 months following the completion of the applicable job. Client agrees that they will not:
If Client directly engages personnel introduced through NestNinja outside of NestNinja during this period, NestNinja reserves the right to invoice Client a placement fee equivalent to the value of services that would otherwise have been billed to Client for that engagement.
